The Contribution to motorway fuel distributors measure is the intervention which, pursuant to article 40 of the legislative decree of 19 May 2020, n. 34 (so-called Relaunch Decree), provides for the provision of a contribution to micro, small and medium-sized enterprises that own the fuel distribution service on motorways, commensurate with the social security and welfare contributions due on employee wages paid in the months of March and April. and May 2020. The financial allocation allocated for the implementation of the intervention is equal to 4 million euros.

Who is it aimed at?

SMEs who are up to date with the payment of social security and welfare contributions as of 1 March 2020 and who, at the date of submission of the application, are in possession of the requirements indicated below can benefit from the benefits: - they are duly established, registered and " active” in the Companies Register, – carry out a fuel distribution service, having a plant, – are not subject to disqualification sanctions pursuant to article 9, paragraph 2, of Legislative Decree 8 June 2001, n. 231 and subsequent amendments and additions, – are in the full and free exercise of their rights and are not in voluntary liquidation or subject to insolvency proceedings with liquidation purposes. The direct management of motorway facilities by integrated oil companies and the unitary management of oil and catering activities are excluded from the benefit. In any case, subjects who, as of 31 December 2019, were in conditions such as to be a company in difficulty, as identified in Article 2, point 18, of Regulation (EU) No. . 651/2014, with the exception of micro-enterprises and small enterprises, classified as such pursuant to Annex I of the same regulation, which can access the benefits referred to in the directorial decree of 14 December 2020 even if already in difficulty on the aforementioned date of 31 December 2019, without prejudice, in any case, to the condition set out in the aforementioned point 4) and that the companies have not received rescue aid or restructuring aid.

What does it predict

The benefit is commensurate with social security contributions, with the exclusion of premiums for compulsory accident insurance, paid by the proposing parties, due on wages from employment in the months of March, April and May 2020, in relation to employees employed at the specific motorway network system. The benefit is granted in the form of an operating contribution, within the limits of available resources, pursuant to and within the limits set by Section 3.1 of the temporary framework adopted with Communication C(2020) 1863 final of the European Commission of 19 March 2020 and subsequent modifications and additions. In the event that the overall amount of the concessions that can be granted is greater than the amount of the aforementioned available resources, the Ministry proceeds with the distribution of the same in proportion to the amount requested by each company. All companies eligible for the benefits compete without any priority associated with the time of submitting the application.
