Who is it aimed at?
Small and medium-sized enterprises (SMEs) and professionals who, among other things:1. are offended parties in a criminal proceeding - initiated on a date prior to the submission of the application - concerning non-payments by debtors accused of crimes, committed within the scope of business activity, referred to in articles: 629 of the penal code (extortion), 640 of the penal code (fraud), 641 of the penal code (fraudulent insolvency), 2621 of the civil code (false corporate communications), 216 of the bankruptcy law (fraudulent bankruptcy), 217 of the bankruptcy law (simple bankruptcy), 218 of the bankruptcy law (abusive use of credit), 223 of the bankruptcy law (facts of fraudulent bankruptcy), 224 of the bankruptcy law (facts of simple bankruptcy), 225 of the bankruptcy law (abusive use of credit). 2. are in a situation of potential liquidity crisis due to non-payments by the accused debtors (uncollected credits towards the accused debtors equal to at least 20% of the total "Credits from customers" referred to in letter C) II – 1) of article 2424 of the civil code), 3. have sufficient capacity to repay the subsidized loan. SMEs must be registered in the business register and be in the full and free exercise of their rights (not be in a state of dissolution or liquidation - not be subjected to insolvency proceedings or out-of-court agreements or sworn plans or restructuring agreements debts). SMEs in ongoing composition with creditors are eligible. Professionals must be registered with professional orders or join professional associations registered in the list kept by the Ministry of Economic Development pursuant to law no. 4/2013 (the certificate issued pursuant to the same law no. 4/2013 must be sent). If the debtor is a legal person, the criminal proceedings must be borne by the legal representative or other natural person attributable to the debtor-legal person.
What does it predict
The facility consists of a loan: – at zero interest, – of an amount not exceeding the credits of the beneficiary towards the accused debtors, documented in the criminal proceedings, and in any case not exceeding €500,000, – with a duration of between three and ten years, including a maximum pre-amortisation period of two years, granted within the limits of incentive intensity provided, depending on the sector to which the beneficiary belongs, by the “de minimis” Regulations no. 1407/2013, n.1408/2013 and n. 717/2014.
